che modifica la decisione (UE) 2022/911 della Banca centrale europea relativa ai termini e alle condizioni di TARGET-ECB e che abroga la decisione BCE/2007/7 (BCE/2022/22)

IL COMITATO ESECUTIVO DELLA BANCA CENTRALE EUROPEA,
visto il trattato sul funzionamento dell’Unione europea, in particolare il quarto trattino dell’articolo 127, paragrafo 2,
visto lo statuto del Sistema europeo di banche centrali e della Banca centrale europea, in particolare l’articolo 3.1 e gli articoli 17, 22 e 23,
considerando quanto segue:

in data 11 giugno 2021 il Consiglio direttivo ha stabilito che una funzionalità di regolamento cross currency nel servizio di regolamento dei pagamenti istantanei in TARGET (TIPS) è in linea con gli obiettivi strategici dell’Eurosistema. A seguito di tale decisione, l’indirizzo (UE) 2022/912 della Banca centrale europea (BCE/2022/8)

(di seguito, l’«indirizzo TARGET») è stato modificato dall’indirizzo (UE) 2026/1473 della Banca centrale europea (BCE/2026/11)

in maniera tale per cui TIPS consentirà, a partire dal 14 novembre 2026, di inviare pagamenti ai partecipanti TIPS o di ricevere pagamenti dai partecipanti TIPS che aderiscono allo schema di bonifico istantaneo denominato One-Leg Out (OCT Inst) SEPA del Consiglio europeo per i pagamenti (EPC).

Le modifiche all’indirizzo TARGET hanno inoltre introdotto un meccanismo in TARGET per consentire ai partecipanti di gestire meglio la loro liquidità consentendo trasferimenti automatici di liquidità tra i conti in contanti principali (MCA) di un partecipante e i suoi conti in contanti dedicati TIPS (TIPS DCA), una volta superato un limite minimo o massimo fissato dal partecipante.

Altre modifiche apportate all’indirizzo TARGET riguardano i termini e le condizioni di TARGET-ECB, compresa la modifica delle tariffe per i titolari di conti in contanti dedicati per il regolamento lordo in tempo reale; pertanto è opportuno che tali modifiche siano rispecchiate nella decisione (UE) 2022/911 della Banca centrale europea (BCE/2022/22)

Pertanto, è opportuno modificare di conseguenza la decisione (UE) 2022/911 (BCE/2022/22),
HA ADOTTATO LA PRESENTE DECISIONE:

l’allegato I è modificato in conformità all’allegato I alla presente decisione;
2)
allegato III è modificato conformemente all’allegato II alla presente decisione;

l’allegato I è modificato, a decorrere dal 14 novembre 2026, in conformità all’allegato III alla presente decisione;
4)
l’allegato III è modificato, a decorrere dal 14 novembre 2026, in conformità all’allegato IV alla presente decisione;

L’articolo 14, paragrafo 2, è sostituito dal seguente:
‘2. The participant may choose to receive a notification if the floor or ceiling amount is breached. In addition, for MCAs, RTGS DCAs or TIPS DCAs the participant may opt for the breach to trigger a rule-based liquidity transfer order.’

l’articolo 26, paragrafo 2, è sostituito dal seguente:
‘2. On the occurrence of either of the events set out in point (a) or (b), all obligations of the participant shall be automatically and immediately accelerated, without prior notice and without the need for any prior approval of any authority, so as to be immediately due.

An event of default referred to in Article 24(1).
(b)
Any other event of default or event referred to in Article 24(2) that has led to the termination or suspension of the participant’s participation, notwithstanding the commencement of any insolvency proceedings in respect of a participant and notwithstanding any assignment, judicial or other attachment or other disposition of or in respect of the participant’s rights.
In addition, the mutual obligations of the participant and the ECB shall automatically be set off against each other, and the party owing the higher amount shall pay to the other the difference.’

Rule-based liquidity transfer orders
1. A TIPS DCA holder may specify a floor and/or a ceiling amount for its TIPS DCA.
2. By setting a ceiling and opting for a rule-based liquidity transfer order, if, following the settlement of an instant payment order, a positive recall answer or a liquidity transfer order, the ceiling is breached, the TIPS DCA holder instructs the ECB to execute a rule-based liquidity transfer order that credits an MCA designated by that TIPS DCA holder. The credited MCA may belong to another participant in TARGET-[insert CB/country reference] or in another TARGET component system.
3. By setting a floor and opting for a rule-based liquidity transfer order, if, following the settlement of an instant payment order, a positive recall answer or a liquidity transfer order, the floor is breached, a rule-based liquidity transfer order is initiated that debits an MCA authorised by the MCA holder. The debited MCA may belong to another participant in TARGET-[insert CB/country reference] or in another TARGET component system. The holder of the debited MCA must authorise its MCA to be debited in this manner.’
